Agreement to these terms
These Terms of Use govern access to and use of this website operated by EverLoo LLC (“EverLoo,” “we,” “us,” or “our”). By using the website, you agree to these Terms. If you do not agree, do not use the website. You must be at least 18 years old and able to enter into a binding agreement to submit a business or service request.
Website purpose
EverLoo provides an online way to submit and coordinate requests for temporary sanitation and site-hygiene services. EverLoo may communicate with independent service providers to evaluate potential fulfillment based on location, requested dates, equipment needs, availability and capabilities. Website content is general information and is not a guarantee that any equipment, provider, service area, date or service level is available.
Booking requests, quotes and service confirmation
“Book Now” submits a booking request only. A booking request, quote request, contact form, email confirmation or customer reference number does not create a reservation or service contract and does not confirm pricing, availability, service coverage, delivery timing or provider acceptance.
Any pricing, scope, service schedule, applicable taxes or fees, cancellation terms and other order terms must be separately communicated and confirmed. No payment is collected or authorized through this website. A service arrangement becomes binding only through a separate written confirmation or agreement that identifies the accepted scope and applicable terms.
Changes and cancellations
You may request a change or cancellation by contacting EverLoo. A request to change or cancel is not effective until acknowledged. Before service is confirmed, EverLoo may be unable to fulfill a request and neither party is obligated to proceed. After service is confirmed, changes, cancellations, refunds and any associated charges are governed by the written quote, confirmation, service agreement or other terms supplied for that order. EverLoo will not impose an undisclosed website cancellation fee merely for submitting an unconfirmed request.
Independent service providers
Delivery, servicing, pickup and related work may be performed by independent service providers. Providers are not guaranteed to be available and may have operational, site-access or safety requirements. The identity and role of the parties responsible for a confirmed service will be addressed in the applicable confirmation or service terms. Nothing on this website represents that EverLoo owns a particular fleet or item of equipment.
Your information and communications
You agree to provide accurate, current information and to have authority to provide any site, company or contact information you submit. You authorize EverLoo to use the submitted information to review and respond to the request and to communicate using the contact methods you select. If you expressly select text messaging and provide consent, message and data rates may apply. Consent to text messaging is not a condition of purchase, and the website does not currently use an automated SMS purchasing or payment system.
You retain ownership of information you submit. You grant EverLoo a limited right to use and disclose it as reasonably necessary to operate the website, evaluate and coordinate the request, communicate with you and potential providers, maintain records, prevent misuse and comply with law. Our handling of personal information is also described in the Privacy Policy.
Acceptable use
You may not use the website unlawfully; submit false, fraudulent, harmful or infringing content; impersonate another person; probe or interfere with website security; introduce malicious code; scrape or overload the service; bypass Turnstile, rate limits or other controls; or use information obtained from the website to harm another person or business.
Intellectual property
The website design, text, graphics, branding and software are owned by or licensed to EverLoo and are protected by applicable intellectual-property laws. You may use the website for its intended purpose but may not copy, modify, distribute or commercially exploit website content without permission, except as allowed by law.
Third-party services and links
The website relies on third-party hosting, security, email and other services and may link to third-party websites. EverLoo does not control third-party websites or guarantee that third-party services will always be available, secure or error-free. Third parties may apply their own terms and privacy practices.
Disclaimers
To the fullest extent permitted by law, the website is provided “as is” and “as available.” EverLoo disclaims warranties concerning uninterrupted operation, error-free content, availability, fitness for a particular purpose and non-infringement, except for warranties that cannot lawfully be disclaimed. Information about accessibility, quantities, placement or regulatory considerations is general and does not replace advice from the venue, governing authority or a qualified professional.
The website and its urgent-request option are not emergency services and do not guarantee a response time. For an immediate threat to life, health or safety, contact 911 or the appropriate public authority.
Limitation of liability
To the fullest extent permitted by law, EverLoo and its members, managers, employees and agents will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenues, data, goodwill or business opportunities, arising from use of or inability to use the website or from an unconfirmed request. To the fullest extent permitted by law, EverLoo’s aggregate liability arising solely from the website or an unconfirmed request will not exceed $100.
These limitations do not apply where prohibited by law and do not limit liability that cannot legally be limited. Liability connected with confirmed services may be addressed in the applicable written service terms.
Responsibility for misuse
To the extent permitted by law, you are responsible for losses, claims or expenses resulting from your unlawful misuse of the website, your intentional submission of false or infringing information, or your violation of another person’s rights. This provision does not require a consumer to waive rights or remedies that cannot lawfully be waived.
Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where another law must apply. Before filing a claim concerning the website, you and EverLoo agree to make a reasonable good-faith effort to resolve the issue by contacting the other party. Any proceeding that is not resolved informally may be brought in a court of competent jurisdiction in Texas, subject to applicable jurisdiction, venue and consumer-protection law. These Terms do not require arbitration and do not prevent either party from seeking relief available in small-claims court or another forum required by law.
Changes, severability and no waiver
We may update these Terms by posting a revised version and changing the Last Updated date. Changes apply prospectively unless applicable law requires otherwise. If a provision is unenforceable, the remaining provisions remain in effect to the extent permitted by law. A failure to enforce a provision is not a waiver.
